Subdivision is when a parcel of land is divided into two or more smaller parcels.  Regulations vary from town to town with many Vermont towns having no subdivision regulations. 

Subdivision regulations are designed to ensure that there is access to parcels and that the parcels can be used as intended.  In other words, could you build a house on the parcel, get to it, and have a septic system and well?  Subdivision regulations also help create clear title to the properties.

Subdivision regulations do not control the use of the land, or size of the lot, which is what zoning regulations accomplish.

In Vermont, there are State as well as local subdivision regulations.  Any land subdivided needs a State Water Supply and Waste Water  permit as well as any required local permits.  In order to get a State permit the land must be "buildable" in most cases.  This means it must be able to support a wastewater (septic) system. 

The best way to find out about subdivision in a town where you are buying property is to contact the town clerk who can direct you to the administrator who can tell you the situation.  You can find the Telephone number for town clerks on our "Town" pages.  For State permits you can contact a permit specialist to see what permits are needed, or that should be in place.

Proper State and local permits, including subdivision permits, are required for there to be clear title to a parcel.  Your attorney will be checking for the necessary permits, and compliance with those permits during the title search.
